DOCUMENT 2: DISCLAIMERS & LIMITATION OF LIABILITY 1. General Legal Disclaimer 1.1 The Platform and all contents, functions, data tracking, and documents hosted within are provided entirely on an "As Is" and "As Available" basis. 1.2 To the maximum extent permitted by applicable UK law, we explicitly disclaim all representations, warranties, conditions, or terms of any kind, whether express or implied, including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a specific purpose, or non-infringement. 2. Exclusion of Third-Party Action Liability 2.1 We assume zero responsibility and accept no liability for the actions, omissions, or professional negligence of any third-party solicitors, legal practices, executors, or external researchers who utilize data retrieved from this Platform. 2.2 The choice of visibility options configured by a Testator during registration (e.g., exposing only solicitor info vs. exposing the full document) remains an autonomous user decision. We accept no liability for any family disputes, contested estates, probate complications, or financial losses stemming from the automatic execution of these user-configured visibility parameters. 3. Absolute Limitation of Financial Liability 3.1 You understand that the sole trader operating Will Searcher is not liable, to the extent permitted by law, for indirect, incidental, special, consequential, punitive, or exemplary damages or losses. 3.2 This absolute exclusion encompasses, but is not limited to: • Losses resulting from the prolonged delay, omission, or failure of an executor to discover a missing Will. • Monetary losses incurred by an estate, beneficiaries, or families due to prolonged or unnecessary probate litigation. • Financial expenditures tied to instructing external solicitors to replicate missing estate documents. • System data loss, unexpected database corruption, or malicious server intrusion (hacking events) that compromises or deletes a registry entry. 3.3 The Liability Cap: Where a competent court in England and Wales determines that the sole trader operating Will Searcher is liable for damages, any applicable limit on liability is subject to consumer-protection law and other non-excludable legal rights. Nothing in this document limits liability where the law does not permit it. 4. Statutory Consumer Exception Protection Notice 4.1 Nothing within these Terms of Service or Disclaimer documents shall act to limit or completely exclude our liability for death or personal injury resulting directly from our proven gross negligence, fraudulent misrepresentation, or any other core liability that cannot be legally limited or excluded under the Consumer Rights Act 2015 or general UK law.
