DOCUMENT 1: TERMS OF SERVICE Last Updated: 26 September 2026 Welcome to Will Searcher (the "Platform"). The Platform is operated by an individual sole trader trading as Will Searcher ("we," "us," or "our"). For enquiries, including privacy requests, email help@willsearcher.com. By accessing or using this website, registering a record, or purchasing a search credit, you ("the User", "the Testator", or "the Searcher") agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using the Platform. 1. Nature of the Service 1.1 The Platform acts as a voluntary digital register where a person can record the location of a Last Will and Testament, solicitor details, and other documents they choose to make available. 1.2 We do not provide legal advice, estate planning services, or legal administrative functions. We are not a regulatory body, law firm, court, or government agency. 1.3 Free registration does not constitute a contract of storage in perpetuity. We act solely as a secure data index subject to the operational constraints outlined herein. 2. User Registrations & Accuracy of Information 2.1 When registering a profile, you warrant that you are the legally authorized Testator or their designated Legal Representative. 2.2 You assume sole responsibility for the absolute accuracy, validity, and truthfulness of the data submitted (including names, dates of birth, contact details, and document uploads). 2.3 We perform no independent validation of the contents of any uploaded documentation or identity data. We accept zero liability for errors, typos, or fraudulent profiles created due to the ingestion of incorrect information provided during registration. 3. Search Credits, Fees, and No-Guarantee Search Matching 3.1 Searchers must pay a non-refundable entry fee of £5.00 per search credit via our designated, secure third-party payment processors (Stripe or PayPal). 3.2 No Refund Policy: The £5.00 fee covers the dynamic technical infrastructure cost of executing a secure database query and anti-bot validation. You explicitly acknowledge and agree that no refunds or chargebacks will be issued if a search yields a "No Record Found" result. 3.3 The Platform does not monitor for future matching records or send notifications if a matching record is registered later. 4. Continuous Service & Modification of Platform 4.1 While we utilize highly resilient serverless infrastructure (Amazon Web Services), we do not warrant or guarantee that the Platform will be available 100% of the time, uninterrupted, or free from server latency, DNS resolution errors, or data transmission failures. 4.2 We reserve the absolute right to suspend, alter, modify, or permanently discontinue the service at any time, for any reason, without prior notice. 5. Termination & Permanent Deletion of Records (Safe Wind-Down) 5.1 Users may exercise their data-protection rights, including requesting deletion of their profile, by emailing help@willsearcher.com. 5.2 If the sole trader permanently discontinues the Platform, access to the service will cease and personal data will be handled in accordance with applicable data-protection law and the published privacy information. Users should retain their original documents and not rely on the Platform as their only copy. 6. Governing Law & Jurisdiction 6.1 These Terms of Service, along with any external legal actions arising from the use of the Platform, are governed by and construed in strict accordance with the laws of England and Wales. 6.2 Any legal proceedings, disputes, or claims must be brought exclusively before the courts of England and Wales.
